PHYSICAL PRODUCTS
Photographer must physically receive product at least 7 days prior to the scheduled shoot. If product is not received in time for the shoot, rescheduling fees will apply.
Any imperfections on products which require extended retouching time (e.g. significant dents/scratches, label defects, reflective surfaces) may incur additional retouching fees.
Photographer will take every precaution necessary when working with Client products, however, will not be held responsible for any damage incurred throughout photoshoot process.
FEES AND PAYMENT
Work on the Client's project relating to either pre-production tasks or shooting will not commence until a 50% deposit is paid and received by the Photographer. Failure to pay the deposit on time may result in delays of deliverables being received and possible cancellation/rescheduling fees.
Final payment of the invoice must be made before Photographer will release the final gallery for download.
REFUND POLICY
Due to the custom nature of the work, the total amount is non-refundable.
EDITING AND REVISIONS
Client has spent a satisfactory amount of time reviewing Photographer's portfolio and has a reasonable expectation that they will perform the Services in a similar manner unless otherwise specified in this Agreement. Client also understands Photographer will use artistic judgment when providing Services for Client, which may include slight variations from pre-production board.
Once approved in the pre-production phase, no further changes to the shot list will be accepted. Should the Client wish to make any changes to the final gallery delivered, the Client must advise via email within 7 days of receiving the gallery. Minimal adjustments may be made at the Photographers discretion, however, any major changes will incur an additional fee.
COPYRIGHT
Photographer owns all copyrights in any and all work(s) created or produced in accordance with federal copyright law whether registered or unregistered. Any and all products produced or created in connection with, or in the process of fulfilling this Agreement, are solely owned by Photographer and may be used in the reasonable course of Photographer's business.
Final deliverables may not be altered, edited, or manipulated in any way other than what the Photographer has delivered to the Client. Exceptions can be made for adding Client business name, business logo, and other advertising or marketing campaign text so long as it does not alter the overall style originally created by the Photographer.
Photographer grants Client a 5 year standard commercial image license that may be used for Client business purposes including website, organic and paid social media, email marketing.
*Additional licensing for image use in magazines, brochures and in-store posters may be granted at Photographer discretion but will incur additional fees. Written notice must be provided detailing how the image will be used and for how long in order to quote these fees accordingly.
FILE STORAGE
Photographer archives all digital proofs after a period of 3 months. Client is responsible for making back-up copies of any and all files purchased from Photographer.
